Important Regulation CC Notice (Expedited Funds Availability Act) Changes Effective July 1, 2025
Important changes to your account agreement – This is a notice of changes to the agreement of the account(s) you have with us. Your account(s) will be governed by the revised terms of the agreement below. The effective date(s) are indicated below.
In accordance with 12 CFR 229, Availability of Funds and Collection of Checks (Regulation CC), we are updating our Funds Availability Policy effective July 1, 2025. These changes impact when deposited funds will be available for withdrawal – increasing the amount made available to you for certain items presented for deposit.
In summary, these changes increased several of the monetary limits within the regulation and tied them to a formula that is derived from data within the Consumer Price Index. While these changes fall short of addressing a much needed overhaul of the regulation generally (non-local checks are still referenced), it did make changes that will require your credit union to take action, potentially make changes to your core system, and communicate with members.
Key Changes to Funds Availability
The first $275 (previously $225) of a check deposit will generally be available no later than the first business day after the day of deposit.
The threshold for Large Check Deposits (229.13(b)), New Accounts (229.13(a)), and Repeated Overdraft (229.13(d)) limits subject to extended holds has increased to $6,725 (previously $5,525).
Special rules for cash withdrawals (229.12d)) at $450.00 and become $550.
These updates align with adjustments mandated by Regulation CC. Our general policy remains the same—most deposits will continue to be available on the day of deposit. However, certain check deposits may be delayed for a longer period, and we will let you know at the time of deposit.
Longer Delays May Apply if:
We believe a check you deposited will not be paid
You deposit checks totaling more than $6,725 on any one day
You have overdrawn your account repeatedly in the last six months
There is an emergency, such as failure of computer or communications equipment.
Special Rules for New Accounts
If you are a new member, the following special rules will apply during the first 30 days your account is open. Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $6,725 of a day’s total deposits of cashier’s, certified, teller’s, travelers, and federal, state and local government checks will be available immediately if the deposit meets certain conditions. For example, the checks must be payable to you (and you may have to use a special deposit slip). The excess over $6,725 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $6,725 will not be available until the second business day after the day of your deposit. Funds from all other check deposits will be available on the ninth business day after the day of your deposit.
